A garage ADU in San Diego needs fire sprinklers only when the primary residence is already required to have them. That is statewide ADU law, not a brand promise and not a Yes/No you can read off a fire-hazard map. The building department that will issue the permit, plus the fire authority for the parcel, still have to apply it to your garage.

When a conversion becomes a dwelling

A storage garage is not a dwelling. An ADU is. HCD’s ADU handbook states that conversion ADUs still have to meet building, health and safety, and fire standards for dwellings. Sleeping rooms need emergency egress. Changing the use is what puts fire questions on the table, not the fact that the walls already exist.

That is a different file from a gym, office, or guest room that stays part of the main house. Those habitable conversions still need a building permit in this county. They are not automatically an ADU, and they are not automatically under the ADU sprinkler sentence. Tell the reviewer which product you are building before anyone prices a sprinkler riser.

What actually triggers sprinklers, and what does not

California Government Code section 66314 is the floor. Subdivision (d)(12) says accessory dwelling units shall not be required to provide fire sprinklers if they are not required for the primary residence. It also says construction of an ADU shall not trigger a requirement for fire sprinklers in the existing primary dwelling.

Read that in two directions. The garage ADU does not inherit a sprinkler mandate just because it is new living space. The existing house does not get forced onto a sprinkler system just because you convert the garage.

The County of San Diego states the same idea for unincorporated land, with one extra hook. County guidance says sprinklers are not required in an ADU when building codes did not require them in the existing primary residence. If that primary residence later went through a significant alteration and is now required to have sprinklers, an ADU created after that alteration must have them too. Inside the City of Escondido, the live ADU FAQ matches the state floor and then names utility follow-ons: sprinklers only if the primary residence is fire sprinklered; if they are required, Escondido also calls for a minimum 1-inch water meter, water service, and backflow, plus a minimum 4-inch sewer lateral for single-family dwellings. That is Escondido’s published FAQ, not a countywide spec. Other cities may ask for different meter or lateral work. Confirm with the department on the permit.

Do not treat a Very High Fire Hazard Severity Zone layer as the sprinkler trigger. County materials we verified say the trigger is the primary residence’s code status. A fire-hazard designation can still affect setbacks, hydrants, and defensible space. Those are separate questions.

Specific sprinkler-head counts, pipe sizes, and installation prices are not in our claims file. Do not budget from a forum number. Ask the licensed pro and the fire authority what the current adopted code requires on this parcel.

Attached garage versus a detached structure

An attached garage sits on the house. A detached garage sits in the yard. Both can become ADUs under state law. Only an attached garage can be a JADU, because a JADU has to be within the walls of the single-family residence (Gov. Code §66333(d)).

Sprinkler law does not flip just because the garage is detached. Section 66314(d)(12) still keys off the primary residence. What can change is fire access, hose-pull distance, and whether the converted structure needs its own water service. Those site facts belong on the plan set. They are not a substitute for the statutory sprinkler sentence.

If you keep one bay as parking and convert the other, say so on the first drawing. Partial conversions confuse reviewers when the fire comment and the parking comment land on different bays. Our partial garage conversion post covers the parking half of that split.

A full ADU conversion is still multi-trade work: framing, electrical, plumbing, HVAC, and drywall. If the price exceeds $500, California requires a written home improvement contract. The downpayment may not exceed $1,000 or 10 percent of the contract price, whichever is less (Business and Professions Code §7159). Verify the license at cslb.ca.gov.

Why the main house’s sprinkler status matters

Pull the primary home’s permit history before you design the garage. Ask whether the house was built with sprinklers, whether a later addition or remodel required them, and whether the current certificate of occupancy treats the house as sprinklered.

If the house is not sprinklered, state law says the ADU is not required to provide them, and building the ADU cannot force them into the house. If the house is sprinklered, the ADU follows. Escondido then publishes extra water-service items. Other cities may only repeat the state sentence. Get the answer in writing from the building department named on your application.

Rural East County parcels add a fire-district review on top of County Building. Jamul and Lakeside homeowners should read the County-specific post linked above. City lots still need the local fire authority named on the plan-check comments, even when the statutory floor is the same.

Do not let a contractor “include sprinklers just in case” without showing you the code path. Unnecessary risers cost money and can force meter upgrades you did not need. Missing sprinklers on a house that already has them will fail inspection.

Who to confirm with on your parcel

Name the jurisdiction first. City of San Diego Development Services, a separate city such as Escondido, Vista, or El Cajon, or County Planning and Development Services for unincorporated land. Then name the fire authority that comments on that address.

Bring three facts: attached or detached garage, ADU or JADU or habitable room, and whether the primary residence is sprinklered. Ask, in that order, whether section 66314(d)(12) applies, whether any local bulletin adds utility work, and what the first plan set has to show.
